LEGISLATION

Women aged 18-35 who have undergone medical genetic examination and have no medical contraindications for being a donor have the right to be a donor. Women of reproductive age (from 18 years of age) who wish to

donate their gametes or embryos to their relatives or to a couple (person) not related to them and in need of medical assistance using assisted reproductive technologies, who have undergone a medical genetic examination and have no medical contraindications to being a donor. The donor can receive monetary compensation for providing his egg by the relevant health institution or the person or couple using the egg, according to a contract signed in advance and duly authenticated. The donor does not have any rights and does not bear any responsibility towards the child descended from him as a result of the use of assistive technologies.

Women aged 20-35 who have given birth at least once in the past, who have undergone a medical-genetic examination in the prescribed manner, as a result of which no contraindications to being a surrogate mother have been found, have the right to be a surrogate mother.

Հայաստանի Հանրապետության օրենսդրությամբ սահմանված կարգով գրանցված ամուսնության մեջ գտնվող կինը կարող է փոխնակ մայր լինել ամուսնու համաձայնությամբ: Կինը չի կարող հանդես գալ որպես փոխնակ մայր, եթե`առկա է Հայաստանի Հանրապետության առողջապահության բնագավառի պետական կառավարման լիազոր մարմնի հաստատած բժշկական հակացուցումներից որևիցե մեկը կամ նախկինում առնվազն երկու անգամ հանդես է եկել որպես փոխնակ մայր: Փոխնակ մայրը միաժամանակ չի կարող լինել ձվաբջջի դոնոր: Վերարտադրողականության օժանդակ տեխնոլոգիաներից օգտվող անձանց և փոխնակ մոր միջև փոխհարաբերությունները կարգավորվում են գրավոր պայմանագրերով, որոնք ենթակա են նոտարական վավերացման: Փոխնակ մայրն իրավունք չունի հրաժարվել իրենից ծնված երեխային հանձնել սույն օրենքով սահմանված կարգով պայմանագիր կնքած անձանց՝ վերարտադրողականության օժանդակ տեխնոլոգիաներից օգտվող անձին կամ ամուսիններին: Փոխնակ մայրն իրենից ծնված երեխայի նկատմամբ չունի որևէ իրավունք և չի կրում որևէ պարտականություն երեխային սահմանված կարգով պայմանագիր կնքած անձին կամ ամուսիններին հանձնելու պահից: Փոխնակ մորից ծնված երեխան սույն օրենքով սահմանված կարգով պայմանագիր կնքած վերարտադրողականության օժանդակ տեխնոլոգիաներից օգտվող անձին է հանձնվում, եթե ԴՆԹ-ի որոշման արդյունքում հաստատվում է, որ՝ փոխնակ մայրը չի հանդիսանում երեխայի կենսաբանական ծնողը:
